The law recognises that you can be separated, but still living ‘under one roof’. For the purposes of divorce proceedings, separation is the state of your relationship. For example, you could be considered to be separated when you and your spouse are no longer together socially or emotionally in a relationship, even though you may still be living (physically) in the same home. There could be many reasons why spouses may still stay together even though their relationship has ended. Spouses may still choose to live together because of financial pressures and they cannot afford to live separately or maintain different households. Spouses may still choose to live together because of emotional or social responsibilities, such as looking after children or caring for other members of the family (even though the relationship between the spouses has deteriorated, each spouse may still maintain their relationships with others). If you are separated from your spouse but you still live with your spouse, you might need to seek legal advice and representation to help you prepare the necessary evidence to submit to the court. If you are unable to prove that you are or have been separated for the minimum period required by law, your divorce application will fail.
